1. PURPOSE OF THE PROCESSING

The data are collected to provide a service, for the execution of a contract, to respond to a request or following a spontaneous conferment of the user. The conferment is optional. Failure to provide it will prevent or limit the provision of the service or the execution of the contract with the interested party.

Personal data will not be processed for purposes other than those for which they were collected.

2. SCOPE OF COMMUNICATION AND DISSEMINATION OF PERSONAL DATA

To provide its services, the Data Controller uses third party service providers of various kinds (so- called data processors).With each of them, the Data Controller enters into a contract that imposes the utmost confidentiality and the adoption of particular security measures according to the guidelines prepared by the European Data Protection Board and other competent authorities.

The persons responsible for the processing to whom the Data Controller may communicate personal data are:

  • storage service providers (e.g. Aruba cloud);

  • consultants and professional service providers (e.g. professional accounting or legal firms);

  • subjects that carry out customer assistance activities (e.g. help desk, etc.);

Personal data are not transferred outside the European Union.
In the event that they are, however, the Data Controller will notify the interested parties and will adopt one of the measures provided for by law (standard clauses, communication to countries approved by the European Commission, BCR, express consent of the interested party).

Personal data are not subject to disclosure. 

3. STORAGE TIME OF PERSONAL DATA 

The personal data of the interested parties registered on the site www.motoricambiretro.com are kept for the time in which the User’s registration remains.
Subsequently, the data are kept for the duration of 10 years and in any case for the period necessary for the limitation periods to mature with regard to possible actions or claims of the interested party. In this case, the data are stored discreetly and subject to special restrictive measures restricting access.

The data may be processed for a further period if the purposes of the processing change (e.g., exercise of the rights of the data subject, litigation or threat of legal action, etc.).

4. LEGAL BASIS OF THE PROCESSING

The Data Controller processes personal data by virtue of the express consent issued by the interested party as well as for the execution of the obligations assumed with the “Terms and conditions of use”.
Other treatments may be performed by the Data Controller if required by law (e.g. billing data services) or by order of the authority (e.g.: exhibition of information in the context of investigations) or if provided for in the contract.

5. AUTOMATED PROCESSING

Personal data are not subject to automated processes, such as profiling.

6. RIGHTS OF THE DATA SUBJECT

Pursuant to Articles. 15 et seq. of Regulation (EU) 2016/679, the interested party may at any time request confirmation from the Data Controller if personal data concerning him or her are being processed, with an indication of the purposes and categories of data. In this case, the data subject may always:

  • request access to and correction of data if inaccurate and integration of incomplete data;

  • request the cancellation of data (upon the occurrence of one of the conditions indicated in Article 17, paragraph 1, of the Regulation and in compliance with the exceptions provided for in paragraph 3 of the same article);

  • request the limitation of the processing (upon the occurrence of one of the hypotheses indicated in Article 18, paragraph 1 of the Regulation);

  • obtain a copy of personal data in a structured and machine-readable format (in cases where the legal basis of the processing is the contract or consent and the same is carried out by automated means – so-called right to the portability of personal data);

  • oppose the processing to the recurrence of particular situations that concern him;

  • revoke consent (limited to cases in which the processing is based on consent).

7. EXERCISE OF RIGHTS 

To exercise the rights indicated in the previous paragraph, as well as to receive further information, the interested party can contact the Data Controller by writing to the e-mail address: info@motoricambiretro.com.
The interested party, in the event that he considers an illegitimate treatment or in the event that he considers that the Data Controller has not given correct feedback to the exercise of the rights referred to in the previous paragraph, may lodge a complaint or appeal to the Guarantor Authority for the protection of personal data pursuant to art. 77 of Regulation (EU) 2016/679 following the procedures and forms published on the website garanteprivacy.it.

The interested party, moreover, can always contact directly to the appropriate judicial offices as provided for by art. 79 of Regulation (EU) 2016/679.

8. COOKIES

Cookies are small text files that the sites visited by users send to their terminals, where they are stored before being retransmitted to the same sites on the next visit.
