All contracts for the sale of products by ANTICO DESIGN 900 RETRO’ SRL are governed by these General Conditions, which form an integral and substantial part of every proposal, order and confirmation of purchase order of the products.

The conditions of sale applicable to your order are those in force on the date of the order itself.

3 – PRODUCTS: PRICES

AD900 ensures that the price shown next to each product is correct and represents the best quality/price/service ratio offered. The prices of the products are indicated in euros excluding VAT.

The prices of the published products cancel and replace the previous ones and are subject to the actual availability of the products.
AD900 reserves the right to confirm or modify the prices of the products published on its website at the time of confirmation of the customer’s order.

4 – ORDERS

All purchase orders for products sent to AD900 must be complete in all their parts and must contain all the elements necessary for the correct identification of the products ordered.
Each order sent to AD900 is equivalent to a contractual proposal from the customer. Therefore, it is binding on AD900 when and only if:

It is complete in all its parts
Contains all the elements necessary to correctly identify the ordered products
It is confirmed and accepted by AD900 through the evasion of the same.

AD900 reserves the right not to accept incomplete orders or orders without the data necessary for their fulfillment.
If products are ordered at that time not available, AD900 will notify the customer as soon as possible, who may choose to have a refund of the product, or a voucher of equivalent value to be used in a subsequent order.

No other sum is due by AD900 to the customer as compensation or compensation whatsoever.
The documentation for tax purposes relating to the products ordered is issued by AD900 at the time of shipment of the same to the customer.

Delivery time:

The delivery of Poste Delivery Standard takes place approximately in 4 days, excluding Saturdays and holidays. Check what you can ship.

For consignments accepted after the time limit, indicated at the post office, the times start from the next working day.

For each shipment there are two delivery attempts. If in both cases the recipient is absent, he has ten days to pick up the shipment at the post office indicated on the notice left by the courier (in the 10 days Saturday is included).

Orders received from Monday to Friday, excluding public holidays, are processed within the next 24 hours if arriving by 10:00 am (CET,UTC+1).
If the order is received after 10:00 (CET,UTC+1) they are processed within the next 48 hours.

Orders received on Saturday and/or Sunday are processed the following Monday.

DELIVERY METHODS

Each shipment is delivered to the address indicated by the sender.The shipping number is particularly important: the Customer can have the information he needs only if he has it. This number is provided by the sender when sending the shipment.

The Customer can check the status of the shipment online, or by contacting the Poste Italiane service center.

AD900 delivers domestic and international shipments on working days from Monday to Friday, throughout the day.
Products are sent in closed boxes or packages.
Delivery is considered completed when the product is made available to the Customer at the address specified in the order form.

Upon delivery of the Products by the courier appointed by AD900, the Customer is required to scrupulously check:
a) That the packaging is not damaged or otherwise altered;
b) That the number of pieces delivered corresponds to what is indicated in the transport document.

Any damage to packaging and products or the mismatch in the number of pieces / packages or indications must be immediately contested by the Customer, who can contact AD900 specifying the order for which these problems occurred.

NON-DELIVERY

In case of impossibility to carry out the delivery even on the agreed day due to the absence of the recipient and after 2 working days without the Customer having contacted the courier, AD900 will try to agree with the Customer to schedule a new delivery.
In the event that AD900 fails to contact the Customer for the next 5 working days or in the event of further impossibility of delivery due to the absence of the recipient, the Products covered by the order will be returned to AD900.

After 30 days from the date on which the Products subject to the order were returned to AD900 due to impossibility in the execution of the delivery, the contract will be considered terminated and the purchase order canceled pursuant to art. 1456 c.c. AD900 will refund the amount paid by the Customer net of the costs of returning the Products and the costs of keeping them at the branch of the courier in charge of delivery.

The termination of the contract and the amount of the refund will be communicated by e-mail.
The amount of the refund will be credited to the means of payment used by the Customer for the purchase.
In the event that, before the expiry of the thirty days, the Customer asks to receive the Purchased Products again, AD900 will proceed with the new delivery upon debit, in addition to the costs of the same, the costs of returning the Products to AD900 and the costs of custody.

AD900 issues an invoice only upon explicit request of the customer, who must – after receiving the automatic order confirmation email – send an email indicating the VAT number and all the details necessary to proceed with electronic invoicing.Once the order has been shipped, AD900 will no longer be physically able to issue an invoice.

The goods travel on behalf and at the risk of the buyer: AD900 will therefore not be held responsible for any delays or damages resulting from transport.

In the event of a refusal of the package, AD900 will request the customer the full amount of shipping costs and the additional cost incurred for the return to the sender of the package.

6 – PRODUCT WARRANTIES

AD900 guarantees only the material integrity of the products at the time of delivery. Any defects must be reported by the customer, under penalty of forfeiture, no later than 10 (ten) days from the date of delivery.
Being vintage goods, the object must be considered purchased with the formula “seen and liked in the state of fact in which it is located”.

All the products published on the site will have their own technical sheet plus photos, in order to show the state of affairs of the same.

Without prejudice to the hypothesis of willful misconduct or gross negligence of AD900, it is hereby agreed that, if the liability of AD900 for any reason towards the customer is ascertained – including the case of total or partial non-fulfillment of the obligations assumed towards the customer as a result of the execution of an order – the responsibility of AD900 cannot be higher than the price of the products purchased by the customer and for which the dispute has arisen.

7 – RIGHT OF WITHDRAWAL

Pursuant to art. 52 et seq. of the Consumer Code (Part III, Title III, Chapter I), the customer may withdraw from the contract with AD900 within 14 (fourteen) days of receipt of the ordered goods. Within this period, the customer must inform AD900 of his decision by sending an explicit statement by email to the address ordini@motoricambiretro.com

Within the following 14 days you must return the goods substantially intact and in its packaging, with a postal package addressed to ANTICO DESIGN 900 RETRO’ SRL via Pergolesi 2, 20124 Milano.
If the Customer withdraws from the contract, he will be refunded all payments made for the purchase of the goods he intends to return, including delivery costs within 14 days of receipt of the notice of withdrawal, upon return of the same. The direct costs of returning the products to AD900 are charged to the Customer.

ATTENTION:

It is necessary to put the item back in its original packaging, closing it well and carefully sealing the package.It is also necessary that the product is intact of all its parts and not used or tampered with: the return of products that are not intact, used even minimally, deteriorated or without accessories or original equipment will not be accepted by AD900 and will be returned to the sender with increased transport costs.
Everything must be sent within 14 days of receipt to: ANTICO DESIGN 900 RETRO’ SRLvia Pergolesi 2, 20124 Milano. It is the customer’s responsibility to ensure that the goods, which travel under his responsibility, arrive in perfect condition.Important: the return should not be sent on delivery, as it would be automatically rejected.
The only expenses payable by the consumer for the exercise of the right of withdrawal are the direct costs of returning the product to AD900.
AD900 will refund in the manner agreed within 5 days of receipt of the returned products

8 – JURISDICTION

All contracts concluded with AD900 are concluded in Italy and are subject to Italian law.For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is that of the court of Milano.
